Health Care Employment Law Summit 2019: Marijuana in the Workplace
Last month, I had the distinct pleasure of speaking at the 2019 Health Care Employment Law Summit in Chicago. You can view a copy of my presentation below. The topic, “Wrestling with Weed in the Workplace”, is current and very important to employers, given the changing landscape towards legal use of cannabis. Employers will want to consider these issues when creating their own drug testing policies.

Testing for Marijuana in the Workplace
With laws changing more and more towards legalization of marijuana use, it is important for employers to understand these laws, establish their own policies, and know how to administer proper drug tests at work. Drug tests for marijuana can detect drug use up to 90 days after the employee’s last experience with the drug. The sample taken – hair, saliva or urine – will depend on the time period you need to test for.
Will CBD Use Show Positive for Cannabis?
It is not supposed to. Since CBD oils are not regulated by the FDA, it is difficult to know if THC is present in the CBD or not, and the level indicated on the package may not be accurate. In order to test positive, there would have to be more than the approved level of 0.3% THC. Repeated applications or usage of CBD’s may lead to an accumulation which can lead to levels that are detected in drug tests. Check the presentation below for links to more resources.
